The following is a reconstructed version of the Limited Warranty Statement provided for the Boost Fin - Electric Surf Fin and its accessories:
- Limited Warranty Period:
This Limited Warranty covers any defects in material and workmanship of the Product that arise from normal and ordinary use. If a defect covered by this Limited Warranty occurs, Arkersport will repair or replace your Product as per the terms outlined in this warranty. The applicable warranty period begins from the original purchase date of the Product with the following durations:
- Boost Fin: 1 year worldwide (2 years for Europe)
- Battery: 180 days
During the warranty period, Arkersport will repair or replace defective parts with new or serviceable used parts that are equivalent or superior in performance. Boost Surf Inc. does not provide any other warranties or representations regarding the performance of the Products.
2.Liability Disclaimer and Limitation:
Arkersport do not assume any other obligations or liabilities beyond those stated in this Limited Warranty. Arkersport. is not responsible for any loss of use, inconvenience, or other damages resulting from any defect in the Product, its component parts, accessories, or service repair. Arkersport is not liable for any third-party claims or claims made by you on behalf of a third party. This limitation applies to all claims, including those based on contract, negligence, strict product liability, or any other legal theory. This limitation of liability cannot be waived or amended by any person. It will be effective even if Arkersport has been advised of the possibility of such damages.
This limited warranty is the sole warranty applicable to the Product, its component parts, accessories, and service repair. Arkersport. disclaims all other warranties, express or implied, except for those warranties that are implied by law and cannot be excluded, restricted, or modified. Any implied warranties not disclaimed by Arkersport. are limited to the duration of this limited warranty or the period provided by applicable country/state law, whichever is shorter. Some countries/states do not allow limitations on the duration of implied warranties, and some do not allow the exclusion or limitation of incidental or consequential damages. Therefore, the above limitations or exclusions may not apply to you.
3. Limited Warranty Exclusions:
This Limited Warranty does not cover damage to the Product caused by: 5.1. Abuse, misuse, neglect, or commercial use. 5.2. Product purchased from a source other than Boost Surf Inc. or an authorized dealer/representative. 5.3. Unauthorized repair or replacement of warranted parts. 5.4. Cosmetic damage, including scratches, dents, or the removal of protective coatings, unless caused by a defect in materials. 5.5. Use of the Product with, or modification of the Product using, any third-party product, component, or accessory not sold by Boost Surf Inc. 5.6. Improper charging, storage, or operation. 5.7. Usage or storage of the Product outside its designated parameters. 5.8. Accident, collision, riding over obstacles, racing, fire, deep water submersion (3 meters+), high-pressure water spray, freezing, earthquake, dropping, severe oxidation, or chemical solvent corrosion. 5.9. Improper packaging or mishandling during shipment to the warranty service provider. 5.10. Use of parts not manufactured or sold by Boost Surf Inc. 5.11. Defects not arising from Boost Surf Inc.'s product design, technology, manufacturing, or quality. 5.12. War or terrorist attack.
